City of Upland v. All Interested Persons (Upland Memorial Park) (2018)
Reason for Suing: The City of Upland agreed to sell a portion of Upland Memorial Park to the adjacent hospital to build a parking structure. The City did not seek voter approval but instead filed a lawsuit asking a judge to validate the sale without voter approval. The Inland Oversight Committee (IOC) and one other member of the public fought the lawsuit on behalf of voters.
Outcome: IOC and the public won. The judge concluded that he did not have the authority to validate the sale and dismissed the City’s lawsuit.
